Measures for the Administration of Earthquake Early Warning in Sichuan Province

 the second These Measures shall be applicable to the planning and construction of earthquake early warning system, the release and dissemination of earthquake early warning information and related supervision and management activities within the administrative region of this province.

 The term "earthquake early warning" as mentioned in these Measures refers to the act of sending out earthquake warning information to areas that may be damaged before destructive seismic waves arrive by using the earthquake early warning system after the earthquake.

 The term "earthquake early warning system" as mentioned in these Measures includes earthquake monitoring, earthquake data transmission and processing, and earthquake early warning information release and broadcasting systems.

 Article The earthquake early warning work follows the principles of government-led, departmental coordination and social participation, and implements the working mechanism of unified planning, unified management and unified release.

 Article 4 The local people’s governments at or above the county level shall strengthen their leadership in earthquake early warning, incorporate earthquake early warning into the earthquake prevention and disaster reduction plan, and include the required funds in the budget at the corresponding level.

 Township people’s governments and sub-district offices shall assist the people’s governments at the county level to carry out earthquake early warning related work.

 Article 5 The departments or institutions in charge of earthquake work of local people’s governments at or above the county level (hereinafter referred to as the competent departments of earthquake work) are responsible for earthquake early warning within their respective administrative areas.

 The departments of development and reform, education, science and technology, public security, finance, natural resources, housing and urban construction, transportation, water conservancy, sanitation and health, emergency management, radio and television, communication management, etc. shall do a good job in earthquake early warning according to their respective responsibilities.

 Article 6 The competent departments of earthquake work of local people’s governments at or above the county level shall guide, assist and urge relevant units to carry out publicity and education on earthquake early warning knowledge and earthquake emergency drills.

 State organs, people’s organizations, enterprises, institutions and social organizations shall carry out publicity and education on earthquake early warning knowledge and earthquake emergency drills.

 The news media should carry out public welfare propaganda such as earthquake early warning and emergency avoidance.

 Article 7 The competent department of earthquake work of the provincial people’s government shall, according to the national earthquake early warning system construction plan and related requirements, combine with the actual situation of this province, jointly with relevant departments, prepare the province’s earthquake early warning system construction plan, and incorporate it into the province’s earthquake prevention and disaster reduction plan, and organize its implementation after being approved by the provincial people’s government.

 Article 8 The competent department of earthquake work of the provincial people’s government shall, in accordance with the construction plan of the province’s earthquake early warning system, make overall use of the existing earthquake monitoring and early warning facilities, organize the construction of a unified earthquake early warning system in the province (hereinafter referred to as the provincial earthquake early warning system) and be responsible for the operation and management.

 City (state), county (city, district) people’s government departments in charge of earthquake work should assist in the construction and operation management of the provincial earthquake early warning system, and can build earthquake early warning facilities in their respective administrative areas according to the needs of earthquake prevention and disaster reduction; After the completion of the earthquake early warning facilities that meet the relevant planning and technical requirements, it shall apply for inclusion in the provincial earthquake early warning system.

 Article 9 Nuclear engineering, high-speed railway, urban rail transit, power supply, gas supply, oil storage, large reservoirs and other major construction projects and construction projects that may cause serious secondary disasters shall install an automatic earthquake warning information receiving and emergency safety disposal system in accordance with the relevant provisions of the state and this province, and ensure the normal operation of the system.

 For the construction projects specified in the preceding paragraph, the construction unit or management unit may build a special earthquake early warning system as required. The earthquake monitoring information of the special earthquake early warning system shall be submitted to the competent department of earthquake work of the provincial people’s government in a timely manner according to law. Special earthquake early warning system meets the relevant conditions, can apply for inclusion in the provincial earthquake early warning system.

 Article 10 The people’s governments of cities (prefectures) and counties (cities, districts) in key earthquake surveillance and defense areas shall install automatic receiving and broadcasting devices for earthquake early warning information in densely populated places such as schools, kindergartens, hospitals, stations, airports, stadiums, tourist attractions and large commercial complexes. Conditional areas can integrate the resources of natural resources, water conservancy, meteorology, emergency management and other departments to realize the sharing of reception and dissemination facilities.

 The management unit of crowded places shall ensure the normal operation of the automatic receiving and broadcasting device for earthquake warning information, broadcast the earthquake warning information immediately, and do a good job in the daily maintenance and management of emergency evacuation passages and emergency shelters.

 Encourage crowded places in other areas to install automatic receiving and broadcasting devices for earthquake early warning information.

 Article 11 Encourage and support social forces to carry out scientific and technological innovation, product research and development and application of achievements in earthquake early warning according to law, and participate in the construction of earthquake early warning system.

 Earthquake early warning facilities invested by social forces meet the relevant conditions and can be included in the provincial earthquake early warning system.

 Article 12 Earthquake early warning information issued by the competent department of earthquake work of the provincial people’s government. No other unit or individual may release earthquake early warning information to the society in any form, and may not fabricate or disseminate false earthquake early warning information.

 Article 13 The competent department of earthquake work of the provincial people’s government shall collect earthquake monitoring data generated by earthquake early warning facilities and form earthquake early warning information in real time.

 When the earthquake prediction parameters reach the threshold of earthquake early warning information release in the region where they are located, the competent department of earthquake work of the provincial people’s government shall release earthquake early warning information to the region through the provincial earthquake early warning system, and notify the member units of the earthquake relief headquarters at the same level and the relevant municipal (state) and county (city, district) people’s governments in real time.

 Earthquake early warning information includes earthquake magnitude, earthquake occurrence time, epicenter location, estimated arrival time of destructive seismic waves, estimated intensity and so on.

 Article 14 The competent department of earthquake work of the county (city, district) people’s government shall, according to the relevant provisions of the state and the degree of damage and social impact that the earthquake may cause, determine the threshold of earthquake early warning information release within their respective administrative areas and report it to the competent department of earthquake work of the provincial people’s government for the record.

 Article 15 The competent department of earthquake work of the provincial people’s government shall establish an automatic broadcasting mechanism of earthquake early warning information, and organize radio, television, telecommunications and other media to broadcast earthquake early warning information to the society in a timely, accurate and free manner in conjunction with radio, television, communication management and other departments.

 Article 16 Due to technical limitations, data errors, force majeure and other reasons, the earthquake warning information is sent by mistake or there is a big deviation, and the competent department of earthquake work of the provincial people’s government shall correct it in time through the original channels and take measures to eliminate the influence.

 Article 17 Encourage and support all kinds of information service enterprises and institutions to carry out value-added services of earthquake early warning information to meet individual needs on the basis of unified earthquake early warning information.

 Article 18 After receiving the earthquake warning information, local people’s governments at all levels and relevant departments shall take timely measures to prevent and mitigate earthquake disasters and their derivatives and secondary disasters in accordance with relevant provisions such as emergency plans.

 Citizens, legal persons and other organizations may, after receiving the earthquake early warning information, take corresponding risk-avoidance measures with reference to the earthquake early warning emergency disposal guidelines.

 Guidelines for earthquake early warning and emergency response shall be formulated and published by the competent department of earthquake work of the provincial people’s government.

 Article 19 After receiving the earthquake warning information, the construction unit or management unit of major construction projects and construction projects that may have serious secondary disasters shall immediately take emergency measures in accordance with relevant industry regulations, technical specifications and emergency plans.

 After receiving the earthquake warning information, the management unit in crowded places shall immediately organize personnel to take emergency measures in accordance with relevant regulations.

 Article 20 The competent department of earthquake work of the local people’s government at or above the county level shall, jointly with the departments of public security and natural resources, strengthen the protection of earthquake early warning facilities and earthquake observation environment, set up protection signs in accordance with relevant regulations, and indicate protection requirements.

 The competent department of earthquake work of the local people’s government at or above the county level shall promptly organize the repair of earthquake early warning facilities and earthquake observation environment if they find that they have been damaged.

 No unit or individual may occupy, damage, dismantle or move earthquake early warning facilities without authorization, and may not endanger the earthquake observation environment.

 Article 21 The competent department of earthquake work of the provincial people’s government shall regularly guide, supervise and inspect the operation and management of earthquake early warning systems and facilities.

 Article 22 Any unit or individual who discovers illegal acts in earthquake early warning activities has the right to report to the competent department of earthquake work of the local people’s government at or above the county level.

 After receiving the report, the competent department of earthquake work of the local people’s government at or above the county level shall promptly organize the investigation, deal with it according to law, and keep the informant confidential.

 Article 23 In violation of the provisions of these measures, unauthorized release of earthquake early warning information to the society or fabrication and dissemination of false earthquake early warning information, disrupting social order, which constitutes a violation of public security management, shall be punished by the public security organs according to law.

 Article 24 In violation of the provisions of these measures, occupy, damage, dismantle, move earthquake early warning facilities without authorization or endanger the earthquake observation environment, the competent department of earthquake work of the local people’s government at or above the county level or the public security organ shall deal with it in accordance with the relevant provisions of the People’s Republic of China (PRC) Earthquake Prevention and Disaster Mitigation Law.

 Article 25 The competent departments for seismic work of local people’s governments at or above the county level and other relevant departments and their staff who, in violation of the provisions of these measures, abuse their powers, neglect their duties or engage in malpractices for selfish ends in the earthquake early warning work shall be punished according to law for the responsible leaders and persons directly responsible; If a crime is constituted, criminal responsibility shall be investigated according to law.

 Article 26 These Measures shall come into force as of April 1, 2024.
